  SUBJECT: Illegal Activities by Small Engine Repair Shop.
  
  On January 30, 2018, I was unable to start my 18" Poulan Pro chainsaw. After changing the fuel, cleaning the air filter and replacing the spark plug; the chainsaw which I purchased February 21, 2015 at Tractor Supply in Vestal, NY, still would not start. My wife and I found the address of a small engine repair shop:

  We called that afternoon, a woman answered, gave us their hours (10am-5pm), said a Deposit of $40.00 would be required and the chainsaw could be checked out and repaired, stating that the carburetor was usually the problem when chainsaws would not start.
  
  I took the chainsaw to the repair shop January 31, 2018 at about 1:35 pm, gave the proprietor the $40. deposit for which he only gave me a Claim Ticket No. A 5662632. He said the chainsaw would be completed in 1 to 1.5 weeks.
  
  At the end of 2-weeks and not having heard from the shop, I stopped there February 13, 2018 2:45 pm. I talked with the proprietor who said he had not done any work on the chainsaw yet. I told him I would take the saw and the deposit to another dealer. He then told me I would forfeit the $40.00 deposit if I removed it then. I left the saw and told him I would speak to someone about what he was doing. He showed me a paper taped to the counter on which he had quickly marked that any deposit would be forfeited if removed.
  
  I returned home and about 4:45 pm, a woman called and said the chainsaw would be too expensive to repair, costing more than a new chainsaw. When I talked with her, she indicated I would probably leave it with them. I told her I would pick it up, which because they closed at 5 pm, I did the next day. I would not leave it for them to repair/resell or use it for parts on other chainsaws!
  
  On February 14, 2018 about 10:20 am, I picked up the saw, the proprietor gave me a copy of the Service Order # A 5662632 on which he indicated "No Compression and Cylinder Scored". On the bottom of the Service Order was the following:
  "While the manufacturer may warrant the goods sold to the customer, we make no warranties, express or implied, including any implied warranties of merchantability or fitness, with respect to
  such goods."
  Proprietor did NOT return any of the deposit and the top cover was not re-installed!
  
  The proprietor never told me about the deposit being forfeited, that none of the deposit would be returned, that they would not warrant their workmanship, and lastly, they did not have me sign the Service Contract in the "AUTHORIZED SIGNATURE" area. I never received or saw the Service Order until I picked up the chainsaw.
